Website Communications and Attorney-Client Relationship

No professional engagement is formed unless and until Stacey expressly agrees in writing to undertake an assignment after any necessary conflicts review and agreement on the scope, timing, and terms of the work.

When first contacting Stacey about possible virtual litigation support, please provide only the information reasonably necessary to identify the parties, describe the general nature of the proposed assignment, and discuss timing and availability. Please do not send privileged, highly sensitive, or confidential documents or information unless Stacey asks you to do so.

Information received in connection with a good-faith inquiry will be handled in accordance with applicable law and professional obligations. Sending information does not require Stacey to accept an engagement and should not be understood as confirmation that she represents you or your firm.

Engagements and Descriptions of Services

Descriptions of Stacey’s services on the Website are general and are provided to help New York attorneys and law firms evaluate whether her virtual litigation-support practice may fit a particular need. They do not constitute an offer, a guarantee of availability, or a promise that Stacey will accept any particular assignment.

Any proposed assignment is subject to Stacey’s availability, an appropriate conflicts review, and written agreement on the scope and terms of the work. Before work begins, Stacey and the hiring attorney or law firm will confirm the assignment, deadline, fee or budget, expected work product, and any applicable communication, file-sharing, or workflow requirements.

No professional services are undertaken unless and until Stacey accepts the assignment in writing. Any signed engagement letter, independent-contractor agreement, or other written agreement governing the work will control over any general description appearing on the Website.

Permitted Use and Intellectual Property

You may access and use the Website for lawful informational purposes, including evaluating Stacey’s background, qualifications, and services. You may download or print materials that the Website expressly makes available for that purpose, solely for your internal evaluation or another lawful use.

Governing Law and Venue

These Terms and any dispute arising solely from access to or use of the Website are governed by the laws of the State of New York, without regard to conflict-of-laws principles.

To the extent permitted by law and subject to applicable jurisdictional requirements, any action arising solely from these Terms or use of the Website shall be brought in a state court located in Dutchess County, New York, or in the United States District Court for the Southern District of New York. You consent to personal jurisdiction and venue in those courts and waive any objection based on inconvenient forum. Nothing in this provision creates subject-matter jurisdiction where it does not otherwise exist.

This section applies only to Website-related disputes. Any dispute concerning professional services will be governed by the governing-law, venue, and dispute-resolution provisions, if any, in the applicable written agreement.

Severability

If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted by law or, if necessary, severed. The remaining provisions will remain in full force and effect.

The invalidity or unenforceability of a provision as applied to one person or circumstance will not affect its application to any other person or circumstance to the extent permitted by law.
